No-Refusal Checkpoints

In an effort to crack down on impaired driving, law enforcement agencies across the state are adopting the practice of “no-refusal” traffic stops and checkpoints. In other words, when a person suspected of DUI refuses to submit to a breath test, police are, in a sense, forcing them to submit to a blood test. Essentially, if a person refuses to submit to a breath test, the officer contacts an “on call” judge who will issue a warrant to obtain a sample of the person’s blood.
